Bio
Whatever strategy a case requires, Joanna Vince focuses on finding the right solutions for clients.
Her goal is to find the most practical and efficient path to a final solution. She has extensive knowledge of environmental law and places great importance on building solid relationships and connections with clients and key stakeholders.
As a Law Society of Ontario Certified Specialist in Environmental Law, Joanna draws on her strong science background as well as her technical and business knowledge to help solve problems. In her broad and diverse environmental law practice, Joanna handles a wide range of environmental issues involving transactions, civil claims, defence of prosecutions, order appeals, and compliance matters. She works with companies on internal due diligence programs and takes the time to understand their operations and obligations. In matters of contaminated land, Joanna provides advice about purchase, sale, remediation and development, and helps clients assess and manage civil and regulatory environmental liability risk. Joanna regularly provides environmental due diligence advice to clients selling or purchasing companies through asset or share transactions. She also helps clients with understanding and complying with the ‘E’ in ESG.
With a deep understanding of unique issues in Northern Canada, Joanna advises First Nations and Inuit communities, resource proponents, and environmental boards and tribunals about natural resource development, environmental impact reviews, wildlife management, legislative amendments and land claim implementation. She has appeared before several co-management boards, including the Nunavut Wildlife Management Board, Nunavut Impact Review Board and Nunavut Water Board.
Joanna helps clients obtain approvals for air, noise, waste, renewable energy and sewage and navigates regulatory processes with clients for a wide range of projects and operations. Joanna appears before the Ontario Land Tribunal to defend and appeal environmental approvals and permits.
Joanna handles environmental and energy litigation for both plaintiffs and defendants. She also defends individuals and companies against environmental regulatory prosecutions, under federal, provincial and municipal legislation, including the Fisheries Act, Canadian Environmental Protection Act, Environmental Protection Act, Ontario Water Resources Act, and municipal bylaws.
Joanna has extensive experience managing negotiations with environmental regulators to avoid issuance of orders and prosecutions, and where issued to obtain terms that are more favourable to clients.
Joanna ensures she has an in-depth understanding of client needs, both in the present and for the future. She spends time with industry organizations and environmental and advocacy groups to stay up-to-date on industry issues.

Northern Law and Indigenous Legal Issues: Damage to Inuit Land by Mining Exploration
On behalf of an Inuit Association, engaged in negotiations with Environment Canada, the Public Prosecution Service of Canada and a mining proponent about impairment of the client’s land and water. -
Environmental and Energy Litigation: Response to Appeal of an Environmental Compliance Approval
Represented a client before Ontario’s ERT on an appeal opposing the client’s Environmental Compliance Approval. -
Environmental and Energy Litigation: Intervention in Pipeline Hearing
Represented a conservation authority to intervene at the National Energy Board on an application to reverse and increase the flow of crude oil through a stretch of pipeline. The NEB adopted much of the client’s evidence, written arguments, and key issues raised. -
Environmental and Energy Litigation: Civil Litigation for Contaminant Migration
Represented property owners impacted by contaminant migration from a neighbouring gas station. The defendant agreed to pay for the cost to complete remedial work and the decrease in property value. -
Environmental Approvals and Assessments: Environmental Assessments
Reviewed prior unsuccessful provincial and federal Environmental Assessments for an aggregate producer, addressed issues raised by intervenors and the review panel, and provided advice about proceeding with a successful EA. -
Environmental Approvals and Assessments: Opposition to an Environmental Compliance Approval
Made submissions on behalf of a food manufacturer to oppose an application for an ECA by a proposed neighbouring facility. -
Environmental Approvals and Assessments: Environmental Compliance Approval
Reviewed noise reports and noise mitigation measures for a transit authority as part of an Environmental Compliance Approval application, facilitated negotiations with the environmental regulator about noise mitigation measures, and ultimately saved the client over $10 million in noise mitigation costs. -
Contaminated Land and Environmental Risk Assessment: Environmental Lease Terms
Reviewed environmental lease terms for properties owned by a real estate investment trust with Canadian and foreign properties, advised about the REIT’s environmental liabilities and responsibilities, environmental lease terms, and potential claims against tenants. -
Contaminated Land and Environmental Risk Assessment: Remediation at an Ongoing Operation
Assisted a chemical company with strategies to remediate contamination on its and neighbouring properties. Negotiated with the environmental regulator and prevented the regulator from requiring further work and/or issuing an order. -
Contaminated Land and Environmental Risk Assessment: Pre-purchase Environmental Due Diligence
Assisted a municipality with environmental due diligence on the purchase of a federal harbor with historical contamination, assessed potential environmental risks, liabilities and obligations and provided recommendations for environmental terms in the Agreement of Purchase and Sale.
